MY SMART BOOK APP TERMS OF USE

These Terms of Use (hereinafter the “Terms”) govern access to and use of the MY SMART BOOK reading application (hereinafter the “Application”), published by MY SMART BOOK SAS, a French simplified joint-stock company (Société par Actions Simplifiée) with a share capital of €1,000, registered with the Nanterre Trade and Companies Register under number 989 655 246, whose registered office is located at 4 Avenue Laurent Cely, 92600 Asnières-sur-Seine, France.
These Terms of Use supplement, and are separate from, the following documents:

The Application allows users to access a digital library of electronic books (ebooks) and audiobooks, as well as a conversational agent that enables readers to interact with their books by asking questions relating to the content of the book.
The conversational agent is available only for digital books purchased from the website www.mysmartbook.fr. Ebooks purchased from the MY SMART BOOK Website for which the conversational agent is available are referred to as “Smartbooks”.
Where the conversational agent is available for a digital book, the “SMARTBOOK” designation is displayed in the information relating to that digital book on www.mysmartbook.fr.
Use of the Application implies full and unconditional acceptance of these Terms.
1. Purpose
The purpose of these Terms is to define:
- The conditions governing access to and use of the Application
- The rights and obligations of users
- The rules governing the use of digital content
- The conditions governing the liability of MY SMART BOOK
2. Definitions
The terms used in these Terms shall have the following meanings:
- Application: the mobile application providing access to ebooks, audiobooks and Smartbooks.
- User: any individual who uses the Application.
- User Account: the personal account created by the User to access MY SMART BOOK services.
- Content: Ebooks, Audiobooks, Smartbooks and all other content available within the Application. Such Content may include notes created by the User and questions and answers exchanged with the conversational agent.
- Service: all features and functionalities provided through the Application.
3. Access to the Application
The Application may be accessed by downloading it from the relevant mobile app stores, including the Apple App Store and Google Play.
For Content purchased through the MY SMART BOOK Website, the Application is accessible through a User Account. In this case, the User Account created on the MY SMART BOOK Website is the same account used to access the Application.
For Content not purchased through the MY SMART BOOK Website, the Application may be used without creating a customer account, provided that the User holds all necessary rights to the Content transferred to and read through the MY SMART BOOK Application.
MY SMART BOOK may:
- Modify the Application
- Temporarily suspend access for maintenance
- Remove or add certain features without prior notice
MY SMART BOOK endeavours to ensure that the Application is available 24 hours a day, 7 days a week, but does not guarantee uninterrupted availability.
4. Creating a User Account
To access certain features, the User must create an account.
An account may be created either through www.mysmartbook.fr or directly through the Application.
When registering, the User must provide:
- A valid email address
- A secure password
- Any other mandatory information specified in the registration form
The User undertakes to:
- Provide accurate information
- Keep their password confidential
- Not share their account with any third party
The User is responsible for all activity carried out through their account.
5. Services Provided
The Application provides:
- Ebook reading
- Audiobook listening
- Access to the User’s library
- Access, for certain Ebooks defined as Smartbooks, to the conversational agent
- Synchronisation between www.mysmartbook.fr and the Application
- Management of bookmarks and annotations created by the User
6. Licence to Use Content
Ebooks and audiobooks are protected by copyright.
The User is granted a personal, non-exclusive and non-transferable licence permitting only:
- Personal reading or listening
- Use on the User’s personal devices
The User may not:
- Copy the Content
- Redistribute ebooks
- Share audiobooks
- Extract audio files
- Circumvent DRM or other technical protection measures
- Publish the Content on the Internet
Any breach of these restrictions may result in suspension of the User Account.
7. Restrictions on Use
The User undertakes not to:
- Use the Application for unlawful purposes
- Attempt to access internal systems without authorisation
- Use robots, bots or automated scripts
- Disrupt or interfere with the operation of the Service
- Infringe intellectual property rights
8. Intellectual Property
All elements of the Application are protected by intellectual property laws, including:
- The software
- The Content
- Logos
- Trademarks
- The graphical user interface
These elements remain the exclusive property of MY SMART BOOK or its partners, as applicable.
Any unauthorised reproduction is prohibited.
9. Personal Data
The Application may collect certain personal data, including:
- Email address
- Usage data
- Reading preferences
- Listening history
Such data is processed in accordance with our Privacy and Cookie Policy.
In accordance with the General Data Protection Regulation (GDPR), Users have the following rights, subject to the conditions provided by applicable law:
- Right of access
- Right to rectification
- Right to erasure
- Right to object
- Right to data portability
10. Liability
MY SMART BOOK shall not be held liable for:
- Interruptions to the Service
- Incompatibility with certain devices
- Loss of data
- Problems relating to the User’s Internet connection
The User is responsible for their use of the Service.
11. Suspension or Termination of an Account
MY SMART BOOK may suspend or terminate a User Account in the event of:
- Breach of these Terms
- Fraud
- Abuse or misuse of the Service
- Infringement of copyright or other intellectual property rights
Suspension may take effect immediately and without prior notice.
12. Termination by the User
The User may delete their account at any time through the Application settings.
Deletion of the account may result in:
- Loss of access to Content
- Deletion of associated data, subject to applicable legal and regulatory requirements
13. Changes to the App Terms of Use
MY SMART BOOK reserves the right to amend these Terms.
Users will be informed:
- Through the Application
- By email
- When logging in to the Service
Continued use of the Application following the entry into force of the amended Terms constitutes acceptance of the new Terms, to the extent permitted by applicable law.
14. Governing Law and Dispute Resolution
These Terms are governed by French law.
These Terms are drafted in French, which shall be the only legally binding language even where translations are made available for convenience. They are intended for users located in France. They are governed by French domestic law, without reference to conflict-of-law rules and excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods.
In the event of a dispute concerning these Terms, you undertake to contact us in order to seek an amicable solution. For this purpose, you must provide us with a complete, substantiated and documented description of your complaint. If no amicable solution can be reached through discussion within one month following receipt of a complete file or of the final document required to complete it, the dispute shall be considered unresolved.

Mediation is one of the Alternative Dispute Resolution (ADR) mechanisms available under French law, which also include conciliation, direct negotiation or negotiation between lawyers, settlement agreements, collaborative proceedings and, where appropriate, arbitration. In the event of a cross-border dispute within Europe, consumers may also contact the European Consumer Centre (ECC).
Any unresolved dispute may be submitted by the most diligent party to the competent French courts in accordance with applicable French procedural rules. Where proceedings are brought by a non-resident or foreign party, jurisdiction shall lie with the Judicial Court of Paris, including in relation to applications for preparatory, interim, emergency, ex parte, summary or similar measures.
